The owner and operator of the website www.osiedlemoderno.pl ("Party") is Fadesa Polnord Polska Sp. z o.o. with its registered office in Warsaw, Al. Jerozolimskie 94, 00-807 Warsaw, entered into the Register of Entrepreneurs maintained by the District Court for the capital city of Warsaw, 12th Commercial Division, under the number KRS 0000235595.

 

FPP Group is composed by the following companies:

  • Osiedle Innovasp. z o.o. with its registered office in Warsaw, Al. Jerozolimskie 94, 00-807 Warsaw

  • FPP Powsin sp. z o.o. with its registered office in Warsaw, Al. Jerozolimskie 94, 00-807 Warsaw

1. Terms of Use of the Website

  1. All rights to the Site, including the rights to its textual content and graphic elements, site layout and other elements are reserved unless expressly stated otherwise.
  2. Using the content posted on the Website does not mean that users acquire any rights on intangible assets to works or databases contained on the Website.
  3. The user may use the works or databases contained on the Website only within the permitted scope of use specified by the provisions of the Act of 4 February 1994 on Copyright and Related Rights and the Act of 27 July 2001 on the Protection of Databases. In particular, apart from the cases specified in these provisions, it is forbidden to copy, modify or transmit electronically or otherwise any part of the Website in whole or in part for commercial purposes, without the prior written consent of FPP.

 

2. Disclaimer of Liability

2.1. The Website aims to provide users with general information about services rendered by the FPP Group Companies, in particular about housing investments of FPP Group Companies.

2.2. The data published on the Website is for information purposes only and it does not constitute an offer within the meaning of the provisions of the Civil Code.

2.3. Although due care has been taken to ensure the accuracy of the information presented, there is a risk of inaccuracies. The FPP Group Companies shall not bear any responsibility nor guarantee the correctness and completeness of the information presented on the Website.

2.4. Information on the availability of apartments, published on the Website, is updated on a regular basis; however, due to technical limitations, only the sales office can provide final and binding information on the availability of a given apartment.

2.5. FPP Group Companies shall not be responsible for any interruptions in the access to the Website and to any information, computer programmes or other content on the Website, as well as for any defects, shortcomings, computer viruses or other electronic signals that may compromise the user in any way. In addition, in the broadest scope allowed by the law, FPP Group Companies exclude any warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

2.6. In no event shall FPP Group Companies, its affiliated companies or partners, agents or employees of the FPP Group Companies or affiliated companies assume any liability to the user or other persons for any decision taken or action made on the basis of information contained on the Website, or for any indirect, special or incidental losses, even in the event of obtaining information about the possibility of their occurrence.

2.7. Some of the links placed on the Website send users to servers and websites administered by third parties, for which the FPP Group Companies shall not be responsible. The FPP Group Companies shall not be responsible for information on those servers and websites, in particular for their truthfulness.

2.8. FPP reserves the right to change the data and information placed on the Website on a date selected by FPP, without prior notification to the Website users.

 

3. Privacy Policy

3.1. By filling in the contact forms available on the Website, users, after providing their consent, may share their personal data: first and last name, e-mail address and telephone number. In accordance with the applicable laws on the protection of personal data, we hereby inform that:

  • the administrator of personal data is Fadesa Polnord Polska sp. z o.o. with its registered office in Warsaw, 00-807, al. Jerozolimskie 94 (hereinafter: ADO);
  • the basis for the processing of personal data is the consent of the data’s owner;
  • the provided personal data shall be processed only for the purpose for which the consent has been granted, i.e. in order to make contact or provide information in connection with sending the contact form;
  • the provision of personal data is voluntary yet necessary to make contact or provide information;
  • personal data may be entrusted to other entities from the Fadesa Polnord Polska capital group, but only in accordance with its processing purpose;
  • personal data may be disclosed to competent authorities on the basis of applicable legal provisions;
  • personal data shall be stored for the period necessary in connection with the contact form provided, no later than until the consent is withdrawn;
  • at any time, the user shall have the right to withdraw consent to the processing of data;
  • the withdrawal of consent to the processing of personal data shall not affect the lawfulness of the processing which has been carried out on the basis of the consent granted before its withdrawal;
  • in order to withdraw the consent, the user needs to send an appropriate information by e-mail to the following e-mail address: daneosobowe@fadesapolnord.pl or by post to the following address: Fadesa Polnord Polska sp. z o.o., Dział Administracji Sprzedaży, Aleje Jerozolimskie 94, 00-807 Warsaw;
  • the user has the right to request ADO to provide access to personal data, rectify or delete it;
  • from 25 May 2018, the user also has the right to request ADO to limit the processing and the right to transfer personal data;
  • the user has the right to lodge a complaint with the supervisory authority – the Inspector General for Personal Data Protection (all information on the manner and form of the complaint is available on the official website of the Inspector General for Personal Data Protection: www.giodo.gov.pl);
  • the person the data refers to shall not be subject to automated decision-making, including profiling.

 

3.3. FPP Group Companies use appropriate technologies and introduce internal procedures in order to maintain the safety of the collected user personal data and to prevent unauthorized access to it. The set of the collected personal data is treated as a separate database, stored on a server in a special security zone, with limited access.

3.4. FPP uses the so-called "cookies" – small text files placed on the user's computer and used when connecting with the Website. Cookies are used to examine the general movement of users on the Website, which in turn allows better understanding of user preferences, but they are not used by FPP or FPP Group Companies to identify or examine the traffic of specific users. Most web browsers allow users to delete cookies from their computers or disable the option of accepting them. Blocking cookies placed by the Website should not cause difficulties in using most of its content.
